Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to clarify the above point of arrest at the time of appearance before the respondent police vide the condition in Crl.O.P.NO.23639/2021 dated 09.12.2021 in Crime No. 119/2008 on the file of the Inspector of Police, Central Crime Branch, Chennai District as far as the wife of the petitioner/Accused and thus render justice. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.X.SELVAM SOUNDER, Advocate for the Petitioner and of MR.A.GOKULAKRISHNAN, Additional public Prosecutor on behalf of the Respondent the court made the following order:- Today, the matter is listed under the caption "for Clarification".

2.The petitioner who was arrested and remanded to judicial custody on 06.11.2021 for the offences under Sections 465,468,471,420 r/w 120 of IPC, in Crime No.119 of 2008, on the file of the respondent police, seeks bail. The petitioner / A2 was granted bail on 09.12.2021 in Crl.O.P.No.23639 of 2021 with conditions.

3.The learned counsel for the petitioner submitted that the wife of the petitioner i.e., A3, is on the way from Dhubai to Chennai AirPort and if there is no specific order "not to arrest", she might be arrested by the respondent police. While granting bail to the petitioner, the learned counsel for the petitioner undertook, that the petitioner's wife will also co-operate for the investigation. Since she is staying at Dhubai, who is aged about 72 years, she also gave undertaking to co-operate for the investigation, as agreed by the learned counsel for the petitioner.

Considering the submission of the learned counsel for the petitioner, this Court while granting bail to the petitioner / husband, and his wife was also directed to appear before the respondent police as and when required for enquiry. But, no order was passed "not to arrest" the petitioner's wife, since she is aged about 72 years. As per the submission made by the husband (petitioner) she is also ready to co-operate for the investigation and prayed that she may not be arrested by the respondent Police. Accordingly, she may be directed to appear before the respondent police as and when required for enquiry.

5.While granting bail to the petitioner in Crl.O.P.No.23639 of 2021 at paragraph 6, the condition was imposed on the petitioner to surrender the passport before the concerned Court. 6.The learned Government Advocate (Crl.Side) appearing for the respondent also submitted that A3 may be directed to surrender her passport.

7.Accordingly, A3 is directed to surrender her passport before the concerned Court within a period of one week from today.

8. Respondent Police is directed not to arrest A3 (wife of the petitioner). She is directed to appear before the respondent Police as and when required for enquiry.
