C.M.P.No.17645 of 2022 in CMA.S.R.No.111109 of 2022 P.T. ASHA, J, The above petition is filed to condone the delay of 1175 days in filing the above appeal.

2. Mr.P.Suresh Srinivasan takes notice for the 2nd respondent.

3. The petitioner has stated that since he was unable to raise the funds for meeting out the Court expenses as well as the Court fees there is a delay in filing the appeal. In the affidavit itself he has made the following statement:- " I humbly submit that I further give an undertaking in the affidavit that the interest for the delay period may be waived. By doing so, the Insurance company will not be at any loss, however if the delay in filing the appeal is not condoned, I will be facing huge monetary loss."

4. In the light of the above sufficient reason the delay is condoned, subject to the condition that the interest for the delay period (i.e.1175 days) will be waived by the claimant.

5. The Registry is directed to number the appeal, if it is otherwise in order.
