JUDGMENT
(Order of the Court was made by Mr.R.SURESHKUMAR.,J.) Though the appeal has been directed against the order passed by the Writ Court dated 26.11.2013 in W.P.No.18383 of 2012, where the Writ Court allowed the said Writ Petition filed by the private respondents herein under which they were directed to be absorbed as regular employees like Forest Watcher by way of creating supernumerary post, today when the Page No.2/5
appeal is taken up for hearing, Mr.R.Jayaprakash, learned counsel appearing for the private respondents on instructions would submit that during the pendency of the Writ Appeal, the private respondents pursuant to the order passed by the Writ Court which is impugned herein, were taken back and they have been appointed as such. Therefore, the prayer sought for in these Writ Appeals has become infructuous.
2. The said statement given by the learned counsel appearing for the private respondents is taken on record, which could not be controverted by the learned Special Government Pleader appearing for the appellants. Considering this aspect, we are inclined to dismiss this Writ Appeal having become infructuous and accordingly the Writ Appeal is dismissed as infructuous. Consequently, connected Miscellaneous Petition is closed. However there shall be no order as to costs.
