The petitioner, who is arrayed as an accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 308, 338, 184 M.V. Act, which was later altered to an offence punishable under Section 304(ii) IPC, on the file of the respondent police, in Crime No.223 of 2016 and seeks anticipatory bail.

2. The case of the prosecution is that on 28.02.2016, the accused have engaged in bike race, in which, two persons have died.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the respondent. He further submitted that the petitioner is a member of the Race Club. On that particular day, he did not participate in the bike race.

The learned Government Advocate (Crl. Side) opposed to grant anticipatory bail stating that two teams participated in the bike race, which was held on 28.02.2016 from Nemilicherry to Vandalore Road and he further submitted that the petitioner is also one of the participants in the bike race, resulted in two death.

5. Considering the above facts and circumstances of the case and also considering the gravity of offences, this court is not inclined to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
