Criminal Original Petition filed under Section 482 of Cr.P.C. praying to transfer the investigation from the jurisdiction of the second respondent to the third respondent. For Petitioner : Mr.K.Mohanamurali For Respondents: Mr.S.Karthikeyan Additional Public Prosecutor

ORDER

This petition has been filed seeking direction to transfer the enquiry in respect of the petition given by the petitioner dated 08.03.2019, from the jurisdiction of the second respondent to the third respondent.

Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents police 1- 3.

Today when the petition is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents 1-3, on instructions would submit that on receipt of the complaint dated 08.03.2019 alleged to be given by the petitioner, the second respondent immediately transferred the same to the first respondent. He would further submit that as of now, no petition is pending on the file of the second respondent. Further the learned Additional Public Prosecutor submitted that at present the said complaint forwarded by the second respondent was misplaced. However, the third respondent is ready to consider the grievances addressed by the petitioner, if new complaint has been received from the petitioner. 4.

In view of the above submission made by the learned Additional Public Prosecutor, this Court directs the petitioner to present a fresh complaint before the third respondent within a period of 15 days from the date of receipt of a copy of this Order. Upon receipt of the same, the third respondent is directed to consider and dispose the said application within a period of one month from the date of receipt of the application, in accordance with law.

With the above directions, this criminal original petition is disposed of.
