Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondent to mutate the Patta/TSLR extract in respect of property situate at Survey Nos.514/1A, 514/1B, 514/2, Lakshmi Nagar situate in Velachery Village, measuring about 1200 Sq.ft thereabouts as per Town Survey Extract Survey No.3/1, Old Survey No.414/11, 514/8, 514/5, 514/12PT, 514/9T, 514/1APT, Block No.140 to the name of the petitioner.

ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The relief sought in this writ petition is to direct the respondent to 1/6
mutate the Patta/TSLR Extract in respect of property comprised in Survey Nos.514/1A, 514/1B, 514/2 measuring about 1200 Sq.ft situated at Lakshmi Nagar, Velachery Village, thereabouts as per Town Survey Extract Survey No.3/1, Old Survey Nos.414/11, 514/8, 514/5, 514/12PT, 514/9T, 514/1APT, Block No.140 (hereinafter referred to as "subject property") to the name of petitioner.
3. The learned counsel for the petitioner submitted that the petitioner purchased the subject property from Mrs.Irfana Azeez and Mr.Azeez Hafeez Shahid vide Sale Deed dated 09.04.2025. He further submitted that the TSLR Extract reflects that Mrs.Isma W/o. Azeez as predecessor-in-title of the subject property instead of reflecting the name of Mr.Azeez Hafeez Shahid (petitioner's vendor). Hence, the petitioner made a Representation dated 22.04.2025 to the respondent requesting to mutate the TSLR Extract in respect of the subject property in favour of the petitioner. That apart, the petitioner submitted an Online Application dated 07.05.2025 for Patta Transfer in respect of the subject property, but, the same was refused. 2/6

The learned Additional Government Pleader appearing for the respondent submitted that if the petitioner submits an Online Application for mutation of Patta in respect of the subject property in her favour and also, if the petitioner pays the necessary fees for the same, the respondent would consider the petitioner's Online Application, within a time frame to be fixed by this Court.
5. The above submission made by the learned Additional Government Pleader for the respondent has been fairly conceded by the learned counsel for the petitioner.

In view of the limited relief prayed by the petitioner, this Court is inclined to dispose of this Writ Petition with the following directions: (i) The petitioner is directed to submit an Online Application for mutation of Patta in respect of the subject property in her favour, within a period of four weeks from the date of uploading of web copy of this order without waiting for the receipt of certified copy of this order. (ii) On submission of such Online Application by the petitioner, the 3/6
respondent shall consider the same, after issuing notice and affording a reasonable opportunity of hearing to the petitioner and all other interested parties including rival claimants, if any, within a period of sixteen weeks from the date of submission of petitioner's Online Application. (iii) Though facts have been set out in affidavit, in view of the limited relief that is sought to be granted, I do not propose to examine the same, lest it may influence the Authority. The respondent shall independently consider the facts and law set out in the petitioner's Online Application and pass appropriate orders in accordance with law including but not limited to the provisions of the Tamil Nadu Patta Pass Book Act, 1983 and Tamil Nadu Patta Pass Book Rules, 1987.
(iv) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the respondent to consider the matter on its own merits and in accordance with law. Rights and contentions of the petitioner and all other interested parties are left open. No costs.
