This petition is filed to condone the delay of 122 days in filing the above appeal. 2.Both the learned counsel for petitioner and first respondent are present.

3.It is seen that the trial Court convicted the first respondent/accused and the Lower Appellate Court acquitted him, against which, the de-facto complainant had filed this appeal.

4.The contention of the petitoner/defacto complainant is that the de-facto complainant was not aware about the finding of the Lower Appellate Court. Later, it came to his knowledge. Hence, the delay has occurred.

5.In view of the same, the delay stands condoned and the petition is ordered.
