Respondents Prayer: Original Application filed under Order XIV Rule 8 of Original Side Rules read with Section 9(ii) of the Arbitration and Conciliation Act, 1996, to grant an order of injunction restraining the second and third respondent herein, their men, agents and servants from in any way proceeding further with the international arbitration between Nissan Motor Company, 2nd respondent herein and Republic of India pursuant to the 2011 Comprehensive Economic Partnership Agreement (CEPA) between Japan and Republic of India pending disposal of the above application. This Original Application has been filed by the applicant to grant an order of injunction restraining the respondents 2 and 3 herein, their

men, agents and servants from in any way proceeding further with the international arbitration between Nissan Motor Company, 2nd respondent herein and Republic of India pursuant to the 2011 Comprehensive Economic Partnership Agreement (CEPA) between Japan and Republic of India, pending disposal of the above application.

2. Today, when the Original Application is taken up for consideration, the learned Additional Advocate General - VIII appearing for the applicant/State submitted through video conferencing that the matter has been settled amicably and she has also produced a copy of the letter vide D.O.Letter No.7418/MID.1/2020, dated 17.08.2020 to that effect and hence, she seeks permission of this Court to withdraw this Original Application. Her submission is recorded.

3. Accordingly, this Original Application is dismissed as withdrawn, as further orders is not required to be passed in this application. The letter dated 17.08.2020 shall form part of this order. Sd/.N.S.K.J.
