C.M.P.Nos.29189, 29191 & 29193 of 2023 in S.A.No.1091 of 2008 C.KUMARAPPAN, J., These miscellaneous petitions in C.M.P.Nos.29191, 29189 & 29193 of 2023 are filed to (i) condone the delay of 3190 days in filing the petition to set aside the abatement;

(ii) set aside the abatement; and (iii)bring on records of the proposed appellants/legal heirs of the deceased sole appellant, respectively.

Heard the learned counsel for the petitioners. The learned counsel for the respondent has no serious objection in this regard.

Considering the reasons that have been set out in respect of these applications and also having been satisfied with the same, these petitions are allowed. Registry is directed to make necessary amendments in the second appeal in S.A.No.1091 of 2008.

Post the second appeal on 18.01.2024.
