O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Section 85 of BNS, 2023 in Crime No.10 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The prosecution case is that due to matrimonial dispute, the petitioner and his family members allegedly harassed the de facto complainant to sign divorce papers. It is further alleged that, at the time of marriage, the parents of the de facto complainant had presented 114 sovereigns of gold and Rs.5,00,000/-, which were not returned by the petitioner.

3. Today, 10.09.2025, when the matter was taken up, the de facto complainant, Pooja, and her father were present before this Court.

4. The learned counsel for the petitioner produced 101.5 sovereigns of jewels as per the list annexed to the intervening petition. The father of the de facto complainant accepted the said jewels, which were handed over in open Court and issued to the de facto complainant.

5. Heard the learned counsels on either side and perused the materials available on record.

6. In view of the above, the matter is referred to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras. Accordingly, the matter is directed to be placed before the learned Mediator, M/s.Sasidevi. The de facto complainant, the petitioner and the de facto complainant's father are agreed to the same. Both the parties are directed to appear before the learned Mediator on 06.10.2025. The learned Mediator shall take steps to conduct mediation and resolve the issue amicably.

7. Considering the nature of the complaint, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of ten days from the date of receipt of a copy of this order before the learned District Munsif and Judicial Magistrate, Madhavaram, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that:

[a] if the petitioner fail to surrender before the concerned Magistrate, within a period of ten days from the date of receipt of a copy of this order, this order shall 3/6

stand automatically cancelled;

[b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[c] the petitioner shall report before the respondent police as and when required for interrogation;

[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 10.09.2025 cda 4/6
