This petition has been filed to set aside the order of dismissal order dated 20.07.2021 made in S.A.No.1091 of 2008.

2. The learned counsel for the petitioner submitted that they have paid a cost of Rs.2,000/- to the respondents in the connected petition in C.M.P.No.22460 of 2023 in S.A.No.1091 of 2008.

3.The learned Counsel for the respondent has no serious objection in allowing this petition.

4.Hence, considering the submission made by the learned counsel for the appellant and having satisfied with the averments made in the affidavit, this petition is allowed.
