ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Section 8(c), 20(b)(ii)(B), 25 of NDPS Act in Crime No.335 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was 1/4

involved in supply of 25 kgs of ganja (Commercial quantity) and the statement recorded from the arrested accused, the role of the petitioner has been revealed. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case based on the statement recorded from the arrested accused, without any material. He further submitted that he is willing to abide by any stringent conditions that may be imposed by this Court and also ready to cooperate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and upon instructions reported that totally there are five accused in this case and that the petitioner is ranked as A5 and that 14 previous cases has been registered against him. He further submitted that they have conducted investigation and final report is also been filed in this regard. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, taking note of 2/4

the submission made by the learned Government Advocate (Crl.Side), the nature of allegation and also the fact that huge quantity of contraband has been transported and though investigation is yet to be completed, this Court is of the view that if the petitioner is enlarged on anticipatory bail, he would indulge in similar offence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
