ORDER
(Order of the Court was made by S.M.SUBRAMANIAM,J.) The habeas corpus petition has been instituted to direct the respondents to produce the detenue, namely, Elakkiya, aged about 23 years.
2. The petitioner states that the marriage between himself and the detenue Ms.Elakkiya had been solemnized. After solemnization of marriage, the third respondent, who is the father of the detenue, had taken away the detenue. Thus, the present habeas corpus petition has been instituted.
3. The learned Additional Public Prosecutor furnished a copy of the petition filed by the detenue Elakkiya in H.M.O.P.No.171 of 2024 before the Family Court at Perambalur.
4. When the detenue herself filed the petition with a prayer to declare
the marriage as null and void, it is for the petitioner to appear before the Family Court and file his response. We do not find any illegal detention of the detenue and thus the habeas corpus petition stands dismissed. Index : yes (S.M.S.,J.) (V.S.G.,J.) 19.10.2024 ss To
