This petition has been filed to set aside the order dated 22.04.2021 made in Crl.MP.No.213 of 2022 in Spl.S.C.No.42 of 2021, on the file of Mahila Court, Tiruppur.

2. The petitioner herein was granted default bail. He was later secured after cancellation of bail due to non compliance of the bail condition and for long abscondence. Now, the petition is filed to set aside the cancellation of bail, stating that the petitioner is in prison for more than 31⁄2 years. The trial is almost completed and posted for defence witness.

3. The learned Government Advocate (Crl.Side) appearing for the respondent police states that taking into consideration the previous conduct of the petitioner herein, if the petitioner is released on bail at this juncture there is every possibility of absconding. The learned Government Advocate (Crl.Side) further states that the trial will be completed within one month.

4. It is a case of POCSO offence, wherein the victim has self 2/4

immolated. This petitioner is a Driver by profession. He states that his abscondence was not willful, but only to his professional engagement.

5. Considering the rival submissions, this Court is of the view that since the trial has reached the crucial stage, the release of the petitioner at this juncture may not be conducive for the completion of the trial. Hence, the petition for setting aside the earlier order dated 22.04.2021 stands dismissed. However, the trial Court is directed to complete the trial preferably within a period of one month.
