ORDER
The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 316(2), 318(2) of B.N.S. in Crime No.646 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of prosecution is that the defacto complainant was working as a Manger at Kansone Hotel. The petitioners having presented themselves as employed in Customs Office and also having possessed strong influence, have approached him and claimed that they could sell imported products such as 2/7
iphones, TVs, Laptops and other items. On believing the same, he had paid a sum of Rs.7,00,000/- and on receipt of payment, there is no response from them. Accordingly, they have cheated the defacto complainant and failed to return the money to him. Hence, the complaint was registered against the petitioners.

The learned counsel appearing for petitioners submitted that they have been falsely implicated in this case as if they have cheated an amount of Rs.7,00,000/-, but in fact, the entire allegation is false, vindictive, wanton and they are no way connected with the offence. He would submit that they have not at all committed any of offence as alleged by the respondent police and they have been falsely implicated in this case and they will abide by any condition that may be imposed by this court. Hence, he prayed to grant anticipatory bail to the petitioners.
4. The learned counsel for intervenor raised objections stating that the he had sent the sum of Rs.7,00,000/- to the account of petitioners and he is having prima facie materials to prove the same. Hence, he prayed to dismiss this petition.
4. The learned Government Advocate (Crl. Side) appearing for respondent raised objections stating that there was a business transaction between defacto complainant and the petitioner for purchase of goods. He 3/7
would submit that the investigation is almost completed. He would submit that that if they are released on anticipatory bail, they would tamper the witnesses and hamper the investigation and the investigation is almost completed. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5. On seeing the facts, it reveals that already there was a money transaction between the parties with regard to purchase of goods and the petitioners are also inclined to settle the issue. Considering that and also considering the fact that the investigation is almost completed and the fact that they would abide by any condition that may be imposed by this court, this Court is inclined to grant interim anticipatory bail till 09.10.2025 to the petitioners subject to the following conditions:
6.Accordingly, the petitioners are directed to deposit a sum of Rs.5,00,000/- (Rupees five lakhs only) into the credit of Crime No.646 of 2025 before the concerned Magistrate within a period of three weeks from the date of receipt of copy of this order and on such deposit, the defacto complainant is permitted to withdraw the amount on filing undertaking affidavit and on production of proper identification and acknowledgement. On such deposit, the petitioners are ordered to be released on interim bail in the event of arrest or on their appearance, within a period of fifteen days from the date on which the order copy made ready, before the Judicial Magistrate 4/7
Court No.II, Alandur, on condition that the petitioners shall also execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each, in which, one surety must be a blood surety, for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for interim anticipatory bail shall stand dismissed and on further condition that:
[a] the petitioners and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity.
[b] the petitioners shall report before the respondent police on every Tuesday at 10.30 a.m. for a period of three months;
[c] the petitioners shall not tamper with evidence or witness either during investigation or trial.
[d] the petitioners shall not abscond either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned 5/7
Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. [f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
Consequently, the connected Criminal Miscellaneous Petition is closed.
