Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the fourth respondent to forthwith release the documents viz., (1) Sale Deed, vide document No.26869 of 2023 and (2) Mortgage Deed, vide Doc. No.26870 of 2023, both dated 01.11.2023, on the file of the fourth respondent, based on the first petitioner's representation dated 23.01.2024.

ORDER

The present writ petition has been filed praying for a writ of mandamus, directing the fourth respondent to release the Sale Deed, bearing Document No.26869 of 2023, dated 01.11.2023 and the Mortgage Deed, bearing Document No.26870 of 2023, dated 01.11.2023, based on the first petitioner's representation dated 23.01.2024.

2. At the outset, it is submitted by Mr.Abishek Murthy, learned Government Advocate for the respondents that the Mortgage Deed, bearing Document No.26870 of 2023, dated 01.11.2023, has already been released. However, the Sale Deed dated 01.11.2023 is kept pending in view of the deficit stamp duty. He would further submit that on payment of the deficit stamp duty, the Sale Deed would be released within a period of two days thereon. The same is agreed to by the learned counsel for the petitioners. Page No.2 of 5

3. Recording the submissions made by the learned Government Advocate, the present writ petition stands disposed of. There shall be no order as to costs. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
