This petition is filed to enlarge the petitioner on bail pending investigation in Crime No.283 of 2023 for the offences under Section 294 (b), 341, 324, 307, 506 (ii) I.P.C. on the file of the Roshanai Police Station, Villupuram District.
2.It is the submission of learned counsel for the petitioner that petitioner is falsely implicated as accused in Crime No.283 of 2023. Though there is a previous enmity between the accused and the opposite party, petitioner was not responsible for the injuries suffered by the victim. Petitioner is in judicial custody from 19.07.2023. Thus, he seeks bail. 3.In response, the learned Additional Public Prosecutor submitted that the accused in this case, defacto-complainant and others are rowdy elements. They have previous enmity. On 18.07.2023 at 11.30 p.m, the defactocomplainant and others visited Panjabi Daba Hotel at NH 45. After having food and getting parcel for the defacto-complainant, they were waiting near Sangeetha Tea Time for getting into the car. At that time, the Settu @ Jayakumar, Anbu @ Anburaj and D.R. @ Rajendiraprasad were blocking 1/5
their way to their car. They have previous enmity. When the defactocomplainant and others asked them to give way to reach their car, accused scolded them in filthy language. Settu took a knife from the car of the defacto-complainant and attacked defacto-complainant on his head. That was blocked by the defacto-complainant with his left hand. Rajendiraprasad held his hand and Anburaj assaulted the defacto-complainant with knife on his head and caused injury. In support of his submissions, he produced an Accident Register showing the nature of the injuries suffered by the defactocomplainant. He further submitted that the petitioner has three similar previous cases pending against him.
4.Considered the rival submissions and perused the records. 5.It is seen from the narration of facts that injured and accused had previous bad antecedents and had previous enmity. The defacto-complainant suffered the following injuries:- "Lacerated wound front parietal region of scalp (10X1X1cm) and Lacerated wound left forearm (5X1X1cm)". There is specific allegation made against this petitioner that he has assaulted the defacto-complainant with knife on his head. The petitioner has three similar 2/5
cases pending against him and investigation in this case is not completed. In such circumstances, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. 08.09.2023 Apd/ep 3/5
