Prayer: Writ petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, forbidding the respondents from cancelling or re-classifying the assignment patta dated 07.12.1972 in S.No.355/2 measuring an extent of 0.81.00 hectares situated at Ichippatti Village, Palladam Taluk, Tiruppur District which was granted to the petitioner's father in favour of Ranga Navithan @ Rangasamy. By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of mandamus 2/7
forbidding respondents from cancelling or reclassifying the assignment patta dated 07.12.1972 in S.No.355/2 measuring an extent of 0.81.00 hectares situated at Ichippatti Village, Palladam Taluk, Tiruppur District which was granted in favour of Ranga Navithan @ Rangasamy.

It is submitted by the learned counsel for the petitioners that the subject property was originally assigned to one Ranga Navithan @ Rangasamy vide assignment patta dated 07.12.1972, issued by the 3rd respondent. The said Ranga Navithan @ Rangasamy, is the 1st petitioner's husband, father of 2nd and 3rd petitioner, father in law of 4th petitioner, grandfather to 5th to 7th petitioner. After the demise of Ranga Navithan, his legal heirs viz., petitioners herein were in possession and enjoyment of the subject property. While so, it is stated that taking advantage of the illiteracy of 1st and 3rd petitioner, the former Village Administrative Office of Ichippatti coerced the petitioner to sign in a blank papers under threat. It is further stated that respondents are now hastily proceeding to cancel allotment order issued in the name of Ranga Navithan @ Rangasamy. Therefore, petitioners filed a Civil suit in 3/7
O.S.No.67 of 2025 seeking permanent injunction against the respondents before the District Munsif Court, Palladam and the same is pending. The respondents are now trying to cancel the patta and reclassify the subject property without any notice to petitioners. Therefore, the petitioners made a representation dated 11.07.2025 to the respondents requesting not to cancel the assignment patta and not to evict them without following due process of law. However, the said representation has not been considered so far. Aggrieved by the same, petitioners have come before this Court.

At the outset, on instructions it was submitted by the learned Special Government Pleader for respondents that there is no proposal either to cancel or reclassify the assignment patta issued in respect of the land comprised in S.F.No.355/2 of Ichippatti village measuring an extent of 0.81.00 hectares. He would further submit that in case if appropriate authority proposes to either cancel or reclassify the assignment patta they would proceed after following due procedure as contemplated under law, which was agreed to by the learned counsel for petitioner. 4/7
5. In view of the submission made by the learned Special Government Pleader for the respondents, in case if appropriate authority proposes to cancel or reclassify the assignment patta the respondents shall proceed after following due procedure as contemplated under law.
6. Accordingly, the writ petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petitions are also closed.
