The matter is listed today to modify the order in W.P.No.4683 of 2022, dated 14.03.2022.
2. The learned counsel for the petitioner made a mention before this Court today (01.12.2022) seeking for modification of the order of this Court dated 14.03.2022.
3. By consent of both the parties, paragraph Nos.4 and 7 of the order dated 14.03.2022 are substituted by this Court as follows: "4. Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for respondents 1 to 3 submitted that no transfer has been effected till date, hence, cancellation of entry is not required. However, he submits that this Court may issue direction to the petitioners to submit fresh application before the second respondent and if such application is filed, the same will be disposed of on merits and in accordance with law, within a time frame to be fixed by this Court."
"7. Be that as it may. However, considering the facts and circumstances and 1/3
without going into the merits of the case, this Court directs the petitioners to file appropriate application before the second respondent in the above regard, within a period of two weeks from the date of receipt of a copy of this order. On such application being filed, the second respondent is directed to pass orders on merits and in accordance with law, within a period of six weeks thereafter, after affording an opportunity of hearing to the petitioner and other persons aggrieved, if any."
Except for the above modification, the remaining part of the order dated 14.03.2022 in W.P.No.4683 of 2022 shall stand unaltered. 01.12.2022 jd Note: Registry is directed to issue fresh order copy to both the parties. 2/3
