This writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records relating to the order passed by the second respondent in proceedings Ka.No.
U.A.Mi/E.Pa/Puzhal/Ko.1/No. 138/24.8.2023, dated 24.08.2023 in respect of the service connection No.051-006-3051, Puzhal Electricity Distribution Circle, Chennai 66, quash the same and consequently, direct the second respondent to issue a revised electricity consumption charges by properly calculating the exact electricity consumed by the petitioner, in respect of the Service Connection No.051-006-3051, Puzhal Electricity Distribution Circle, Chennai 66. 2.The learned counsel appearing for the petitioner submitted that the petitioner is doing business under the name and style of 2/5
Venkateswara Recreation Club and he obtained electricity service connection for the same. A fire accident took place in respect of the meter in respect of the service connection and the same was informed to the second respondent and a new meter was installed, however, after installation of the new meter, the petitioner received the impugned order directing the petitioner to pay a sum of Rs.37,52,486/- and further submitted that pursuant to the order of this Court dated 05.09.2023, the petitioner has paid a sum of Rs.10 Lakhs. The learned counsel further submitted that the impugned order was passed without providing any opportunity to the petitioner and without conducting any enquiry. Hence, this Court may without going into the merits of the case, issue direction to treat the impugned demand as show cause notice and permit the petitioner to file his objection before the second respondent and issue direction to the second respondent to consider the said objection and to pass appropriate orders.
3.The learned Standing Counsel appearing for the respondents submitted that if the petitioner makes any objection, the same will be considered by treating the impugned order as show cause notice and appropriate orders will be passed. 3/5
4.In view of the above, this Court without expressing any opinion on the merits of the case, directs the respondents to treat the impugned order as show cause notice and permits the petitioner to file his objection before the second respondent, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such objection from the petitioner, the second respondent is directed to consider the same, provide opportunity to the petitioner and pass appropriate orders, within a period of ten weeks thereafter. 5.The writ petition is disposed of. No costs.
