Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent to implement the order in Na.Ka.No.6503/2022/A4, dated 23.03.2023 under Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

ORDER

This Writ Petition has been filed for a direction, directing the second respondent to implement the order passed by the second respondent dated 23.03.2023.

2. Heard the learned counsel appearing for the petitioner, the learned Additional Government Pleader appearing for the respondents 1 & 2 and perused the materials available on record.

3. It is seen that the petitioner lodged a complaint as against the respondents 3 and 4 herein seeking maintenance under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. After conducting enquiry, the second respondent, by an order dated 23.03.2023, directed the respondents 3 and 4 herein to pay a sum of Rs.5,000/- to the petitioner as monthly maintenance. However, the 3rd and 4th respondents did not comply with the same. Therefore, the petitioner submitted a representation before the first respondent. On perusal of the representation revealed that the petitioner sought for some other relief except the execution of the order passed by the second respondent.

In view of the above, the petitioner is at liberty to submit fresh representation before the second respondent for implementation of the order passed by the second respondent dated 23.03.2023, within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the second respondent is directed to consider and pass orders to execute the order of maintenance as against the respondents 3 and 4 herein within a period of four weeks thereafter.

5. With the above directions, this writ petition stands disposed of. No costs.
