PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of habeas Corpus, directing the 1st and 2nd respondents police herein to produce the petitioner's minor grandson, Gurudevan, aged about 31⁄2 years, from the 3rd Respondent herein and produce before this Court and set him at liberty.

Though the petitioner being a grand father of the third respondent's minor son had sought for the larger relief to set his minor grandson at liberty to secure and send with him, the learned counsel for the petitioner submitted that the petitioner would be satisfied if he is granted visitation rights to see his minor grandson.

2. His request appears to be reasonable. Since the petitioner's son /third respondent's husband had been expired and the custody of the child is

with the third respondent / mother, we are of the view that the petitioner, being a grandfather, can be permitted to visit his grandson once in a fortnight at the residence of the third respondent.

3. Accordingly, the petitioner is granted liberty to visit his grandson at the third respondent's residence at No.20/36, 2nd Street, Somasundharam Bharathi Nagar, Vadapalani, Chennai once in 15 days after giving prior notice to the third respondent. During such visit, neither the third respondent nor any other person on her behalf shall, cause unpleasant scene which may hamper the cordial visit.

4. The Habeas Corpus Petition stands disposed of accordingly. No costs.
