Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the 1st respondent and the 2nd respondent to thoroughly investigate on the complaints registered in 91/2016 dated 28.02.2016 of the petitioner against the above said persons.

ORDER

The petitioner has come forward with this petition seeking a direction to the respondents 1 and 2 to thoroughly investigate on the complaint in C.S.R.No.91/2016 dated 28.02.2016 of the petitioner against the above said persons.

2.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel appearing for the petitioner would submit that the petitioner has given a complaint on 28.02.2016 and it was assigned C.S.R.No.91/2016, but the respondents have not enquired into the matter and registered a case. Hence, the petitioner has come forward with this petition. 4.The learned Additional Public Prosecutor would submit that the complaint given by the petitioner was assigned C.S.R.No.91/2016 by the Arni Town Police Station and petition enquiry is pending. He would further submit that the petitioner is not co-operating for the enquiry and prayed for the dismissal of the petition.

5.Considering the submissions made on either side and on perusal of the typed set of papers it is known that the complaint given by the petitioner was assigned C.S.R.No.91/2016 by the Arni Town Police Station. Hence, this Court directs the third respondent to enquire C.S.R.No.91/2016 as expeditiously as possible and follow the dictum laid down in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC)] and register a case, if any cognizable offence is made out. The petitioner is directed to co-operate for the enquiry with the respondent police. The petitioner is also directed to appear before the third respondent on 30.03.2016 along with all relevant documents.
