Since the conclusion of the judgment is contrary to the discussion in the main body of the judgment, the appeal should have been allowed, instead of being dismissed.

Accordingly, the last paragraph of the judgment shall read as under:

"With the aforesaid observations, the Writ Appeal is allowed. No costs. Consequently, C.M.P.No.

24365 of 2019 is closed."

Registry is directed to issue fresh order copy to the parties free of cost.
