The petitioner who apprehend arrest at the hands of the respondent police for the offence punishable under Section 174 of Cr.P.C, in Crime No.407 of 2023 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioner and the de-facto complainant are neighbours and the first petitioner and the de-facto complainant's daughter are lovers, on knowing the same, the deceased Vijayalakshmi opposed and warned her daughter. On knowing the same, the petitioner asked to perform marriage with de-facto complainant's daughter and the same was refused. On 27.07.2023, there was a wordy quarrel between the deceased and her daughter on frustration her mother committed suicide. Hence the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner. 4.Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the investigation is still pending and Section 174 of Cr.P.C is not altered into Section 306 of I.P.C.
