This petition is filed to condone the delay of 23 days in filing the above appeal in CMA.SR.No.114734 of 2023.

2.The second respondent insurance company was served, but none offered to enter appearance. When the Court was about to set R2 ex-parte, Mr.J.Michael Visuvasam, a panel lawyer of R2 offered to enter appearance for R2.

3.Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed and the Registry is directed to number the above C.M.A.SR.No.114734 of 2023, if the papers are otherwise in order.

4.In the eventuality of the petitioners succeeding in the appeal, interest may have to be reckoned only from the date on which the Registry takes the appeal on record.
