The Petitioner, who apprehends arrest at the hands of the Respondent police for the offence punishable under Section 379 & 430 of IPC, r/w.Section 21(1) of Mines and Minerals (Development & Regulation) Act, in Crime No.448 of 2023 on the file of the Respondent police, seeks anticipatory bail. 2.Today, when the matter is taken up for hearing, learned Government Advocate (Crl. Side) appearing for the Respondent Police submitted that on 18.08.2023, the Petitioner illegally transported 1⁄4 unit of river sand in a bullock cart without having any valid permit from the competent authority.

3.Heard the learned counsel for the Petitioner and the learned Government Advocate (Crl. Side) appearing for the Respondent Police. 4.Taking into consideration the facts and the submissions made by the learned counsel on either sides and the fact that the matter is arising out of illegal transport of river sand and as per the direction of the Hon'ble Apex Court, I am not inclined to grant anticipatory bail to the Petitioner. 5.Accordingly, this Criminal Original Petition is dismissed. 12.09.2023 sai https://www.mhc.tn.gov.in/judis 1/ 2
