ORDER
This Petition is filed praying for an Writ of Mandamus to direct the respondents to consider the representation of the petitioner dated 03/04/2025 and to correct the entry made in the computerized patta in respect of petitioner's property at No.4/19, First Canal Cross Street, Gandhi Nagar, Adyar, Chennai 600020, comprised in S.No.9, T.S.No.55, Block No.31 of Kottur Village. 2.It is submitted by the learned counsel for the petitioner that the petitioner filed a representation on 03.04.2025 along with necessary documents to rectify the error in the revenue records and issue patta in his name. However, the said representation has not been considered so far by the first rsepondent. 2/6
Aggrieved by the same, the petitioner has come before this Court. 3.Though the present Writ Petition has been filed seeking writ of mandamus, the learned Special Government Pleader submitted that originally the representation of the petitioner dated 26.02.2025, to correct the entries in the computerised patta was submitted before the third respondent/Tahsildar, the same was considered and rejected. Aggrieved by the same the petitioner has submitted a representation dated 03.04.2025 before the first respondent, who is an Appellate authority. He further submitted that under the Tamil Nadu Patta Passbook Act, an appeal against the orders of the Tahsildar lies before the District Revenue Officer. He further submitted that the representation of the petitioner dated 03.04.2025 would be treated as an Appeal. Agreed to by the learned counsel for petitioner.
5.In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, st respondent, to consider the representation there shall be a direction to the 1 dated 03.04.2025 made by the petitioner on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner and any other interested parties/rival claimants, if any, within a period of twelve (12) weeks from the date of uploading of web copy without 3/6
waiting for receipt of certified copy, by treating it as Appeal under Tamil Nadu Patta Passbook Act. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the respondent concerned to consider the representation on its own merits and in accordance with law.
