C.M.P.No.20942 of 2024 in C.M.A.SR.No.80027 of 2013 M.DHANDAPANI, J., These petitions have been filed seeking to condone the delay of 1934 days in filing the petition to restore M.P.No.3 of 2014 in C.M.A.SR.No.80027 of 2013.

2. Mr.J.Chandran learned counsel takes notice on behalf of the 4th respondent.

3. Though notice was served and the name of the 2nd respondent was printed in the cause list, none appeared on his behalf.

4. Heard learned counsel on either side.

5. In view of the endorsement made by the learned counsel for the petitioner, notice to the respondents 1 and 3 is dispensed with.

6. Being satisfied with the reasons stated in the affidavits filed in support of the petition, this Court is inclined to order this petition. Accordingly this petition is allowed. It is made clear that in the event of this Court enhancing the award amount, the petitioners shall not be entitled to any interest for the delay period. Registry is directed to number the appeal, if it is otherwise in order.
