The Advocate Commissioner appointed by this Court has filed a interim report, wherein, it has been stated that the applicant has informed the learned Advocate Commissioner that the vehicle was not traceable and therefore he will inform the Advocate Commissioner as and when the same is traceable. It is noticed that the vehicle appears to be in the State of Uttaranchal. The loan agreement dated 30.05.2022 which contains an arbitration Clause.

2. Considering the above, this application is closed with liberty to the applicant to invoke the arbitration Clause before the Arbitrator to resolve the dispute between the parties. The applicant is at liberty to file a similar application before the learned Arbitrator under Section 17 of the Arbitration and Conciliation Act, 1996.
