This application has been filed seeking to set aside the ex-parte order dated 07.09.2022.

2.In the affidavit filed in support of the said application, it had been stated that the applicant / 1st defendant was unwell and owing to the health issues, he was not able to give proper instructions to the counsel for preparation of the written statement.

3.Heard the learned counsel for the respondent also.

4.In view of the above reasons and also since it would only be appropriate that all the parties are given an opportunity to raise all possible pleadings in any civil litigation, the ex-parte order dated 07.09.2022 is set aside. This Application is allowed.
