The first defendant presented this application for condonation of the delay of 1072 days in filing the written statement. In the affidavit in support thereof, the ill-health of the first defendant is cited as the reason for the delay. Learned counsel for the plaintiffs, on instructions, states that he has no objection to this application being allowed.

2. Since sufficient cause is shown, this application is allowed. Consequently, the Registry is directed to receive the written statement, if otherwise in order. The parties are directed to file draft issues and undertake admission / denial of documents filed by the counter party.
