Prayer in W.P.No.28152 of 2025: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of mandamus, directing the respondent to pay the petitioner interest for the belated payment of 640 days in paying the petitioner PF, Gratuity and Earned Leave with interest at the rate of 12% within a specified time, as may be fixed by this Court. Prayer in W.P.No.28154 of 2025: Writ Petition filed under Article 226 of Constitution of India, seeking for an issuance of writ of mandamus, directing the respondent to pay the petitioner interest for the belated payment of 610 days in paying the petitioner PF, Gratuity and Earned Leave with interest at the rate of 12% within a specified time, as may be fixed by this Court. COMMON ORDER By consent, these writ petitions are taken up for final disposal at the admission stage itself.

All these writ petitions are filed to direct the respondent to pay 12% interest for the belated payment of PF, Gratuity and Earned Leave to the petitioners, herein within a specified time.

The case of the petitioners is that they were appointed in the respondent Transport Corporation on various dates and after completion of unblemished service, the petitioners in W.P.Nos.28148, 28150, 28152, 28153 of 2025 were retired on 31.05.2023 and the petitioner in W.P.No.28154 of 2025, retired on 28.02.2023. However, the terminal benefits have been settled to the petitioners in W.P.Nos.28148, 28150, 28152, 28153 of 2025 on 10.03.2025 and to the petitioner in W.P.No.28154 of 2025 on 30.10.2024 and no interest has been paid for the delayed period. In view of the same, petitioners have submitted their respective representations to the respondent to pay interest for the delayed period. Since the same were not considered, the present Writ Petitions have been filed.

The learned Standing Counsel for the respondent would fairly submits that in view of the similar order passed by this Court in W.P.Nos.40031, 33742 and 35806 of 2024, they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.

Heard the learned counsel for both sides and perused the materials available on record.

In view of the submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondent to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of eight weeks from the date of receipt of a copy of this order.
In the result, all these Writ Petitions are disposed of with the above directions. No costs.
