The petitioners, who apprehends arrest for the alleged offence under Sections 11(1), r/w 12 POSCO act 2012 subsequently altered the section 5(1), 6, 11(1), 12, 17 of POSCO act 2012 r/w 506(i) of IPC in Cr.No.15 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the first accused Vinarasu gave love torture to the defacto complainant's daughter and the petitioners who are the parents of the first accused supported their son. Hence the complaint.
3. The learned counsel appearing for the petitioners submitted that the petitioners have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that the A1 was already arrested and remanded to judicial custody. Hence prays for grant of anticipatory bail. 4.The learned Government Advocate (Crl.Side) submitted
that the petitioners are the Aunty and Uncle of the victim girl and their son Vinarasu gave love torture to the victim girl with the support of his parents who are the petitioners herein. He further submitted that the A1 has already been arrested and remanded to judicial custody. Hence, he opposed to grant anticipatory bail to the petitioners.
5. Considering the facts and circumstances of the case and the gravity of offence committed by the petitioners, this court is not inclined to grant anticipatory bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 14.12.2022 dpq
