The petitioner/accused, who was arrested and remanded to judicial custody on 27.12.2023 for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) and 25, 29(1) of NDPS Act, in Crime No.63 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner was arrested and remanded to judicial custody on 27.12.2023, for illegal possession of 30 Kgs of Ganja. Hence, the case.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. Hence, he seeks bail.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner was arrested and remanded to judicial custody on 27.12.2023, for illegal possession of 30 Kgs of Ganja and the petitioner 1/3

is having 4 previous cases. Hence he opposed to grant bail to the petitioner.

Heard both side counsels and perused the materials available on record.

Considering the representation made on either side and considering the fact that the quantity of material involved in this case comes under the commercial quantity and also the petitioner is having previous cases for similar kind of offence, this Court decline to grant bail to the petitioner at this stage.
