The Official Liquidator v. M/S.Srikara Agencies
Comp.A.No.806 of 2017 Comp.A.No.806 of 2017 in C.P.No.274 of 2009 K.KUMARESH BABU, J.
Heard Ms.B.Ambili, Deputy Official Liquidator appearing for the applicant.
2. Inspite of effective substituted service, the respondent had failed to appear before this Court. Even before the Master, there was no representation on the side of the respondent. Even today, when the matter is taken up for hearing, inspite of name of the respondent being printed in the cause list and being called up, the respondent remained absent.
3. I have perused the materials and also the evidence recorded before the Master.
4. Ex.A1 is the Demand Notice issued by the Office of the Official Liquidator which had been followed by a reminder under Ex.A2. The statement of affairs of the Company has also been marked as Ex.A4, from which the claim made by the Official Liquidator under the Demand notice stands proved. Hence, I am inclined to allow this Application as prayed for. The respondent is directed to deposit a sum of Rs.2,32,052/-together with interest at the rate of 18% p.a. from 14.03.2014 within a period of eight weeks from the date of receipt of a copy of this order.
