This petition is filed to condone the delay of 1149 days in filing the above C.M.A.

2.There is no representation for the respondent.

3.Learned counsel for the petitioner submitted that the appeal was delayed because the defendant, Ganesan was ailing. Now, he has passed away and hence, this appeal is filed by the legal representatives of the deceased defendant.

4.Heard. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

5.The Registry is directed to number the above C.M.A.SR.No.10764 of 2017, if the papers are otherwise in order.
