A.No.4663 of 2022 in C.S.No.299 of 2002 G.CHANDRASEKHARAN,J., This application is filed to pass an order regarding striking out the name of the 5th plaintiff from array of plaintiffs in C.S.No.299 of 2002. 2.The learned counsel for the respondents states that he has no objection for striking out the name of the 5th plaintiff from the array of plaintiffs. 3.The reason for deleting the name of the 5th plaintiff is that he executed an Oral Hiba gifting his share in the suit property in favour of the 4th plaintiff and confirmed it by an affidavit titled "Affidavit Confirming the Oral Gift made on 08.09.2014".

4.Being satisfied with the reasons stated in the affidavit filed in support of the application and that the respondents have no objection for allowing this application, this application is allowed. Plaintiff has to make necessary amendment in the plaint.
