Mr. R.U.Dinesh Kumar, learned Additional Government Pleader takes notice on behalf of the respondents. By consent, the writ petition is taken up for final disposal at the admission stage itself. 2.The writ petition has been filed seeking issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the order of the second respondent proceedings vide Roc.No.1785/2024 (A1) dated 03.06.2024 and quash the same as illegal improper, incompetent, and ultra-virus and consequentially direct the second respondent to reinstate the petitioner in the post of Village Administrative Officer, Gurubarahalli Revenue Village, Pappireddipatti Taluk, Dharmapuri District with all back wages. 3.The learned counsel appearing for the petitioner would submit that the petitioner was suspended on 03.06.2024. It is the contention of the petitioner that in order to review the suspension, the petitioner had given representation on 23.07.2025 and such representation is 2/5
pending with the respondent.
4.At this juncture, the learned Additional Government Pleader on written instructions from the Revenue Divisional Officer, Harur, would submit that the respondents have already initiated criminal prosecution and Revenue Divisional Officer has given sanction in this regard on 05.02.2025. He would further submit that the respondents have not received any representation from the petitioner. Hence, prayed for dismissal of the writ petition.
5.I have given my anxious consideration to either side submissions.
6.Though the Revenue Divisional Officer has given sanction for initiating criminal prosecution, the petitioner contends that he has given representation to review the suspension and the same is pending with the respondent, however, there is no proof filed before this Court for such representation.
7.In view of the above factual position, without going into the merits of the writ petition, this Court directs the petitioner to give fresh 3/5
representation to the respondents, within a period of two weeks from the date of receipt of a copy of this order. If any such representation is received from the petitioner, the respondents shall consider the same, upon its own merits and in accordance with law and pass orders by following the applicable Government Orders, within a period of eight weeks thereafter.
8.The writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
