ORDER
This writ petition has been filed for the issue of writ of mandamus directing the respondents 1 to 4 respondents to act upon the representation made by the petitioner wherein the petitioner is seeking for preventing the 6 th respondent from converting the residential premises to a prayer hall.
2. When the matter was taken up for hearing today, the written instructions from the 3 rd respondent was placed before this Court and the relevant portions are extracted hereunder,
3. It is clear from the above that the representation made by the petitioner was considered and it was found that the 5 th respondent is utilizing the property as a prayer hall. It is too well settled that the residential property cannot be used as a prayer hall without obtaining the permission of the District Collector. Therefore, there shall be a direction to the 3 rd and 4 th respondents to ensure that the 5 th respondent does not use the residential property as a prayer hall. If the 5 th respondent wants to utilise the property as a prayer hall, they have to necessarily obtain the permission of the District Collector as per Rules.
