PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents herein to provide opportunity to move the enhancement appeal files to the Magisterial Court the purposes of land acquisition of petitioner's property comprised in survey No. 167/2B, situated at 87 Goundamapalayam, Kumaramangalam Post, Thiruchengode Taluk Namakkal, Tamilnadu-637205 by considering the representation dated 21.03.2025 before the respondents. ORDER
By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
2. The present writ petition is filed praying for a writ of Mandamus to direct the respondents to provide opportunity to move the enhancement appeal files to the Magisterial Court for the purpose of land acquisition in respect of the property comprised in Survey No.167/2B, situated at 87 Goundamapalayam, Kumaramangalam Post, Thiruchengode Taluk Namakkal, Tamilnadu-637205 by considering the representation dated 21.03.2025. 2/4
3. Though the present writ petition is filed praying to consider the petitioner's representation dated 21.03.2025, learned counsel for petitioner would now request that a certified copy of the award passed under the Tamil Nadu Highways Act, 2001, may be issued/provided to enable the petitioner to seek compensation in respect of the subject property that have been acquired. To which, learned Additional Government Pleader for respondents would submit that the above request would be considered and certified copy of the order/award would be furnished at petitioner's cost.
4. In view thereof, the writ petition stands disposed of. The respondents shall consider petitioner's request and issue certified copy of the order/award at petitioner's cost, within a period of two weeks from the date of uploading of web copy without waiting for receipt of certified copy.
