Respondent(s) PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records of the 1st respondent to the impugned order Ref.no.Na.Ka.22907/2021/AA1 dated 17.08.2023 and quash the same and consequentially direct the respondents to grant patta to the petitioner for the land situated in S.No.210/2 of Kunniamuthur village,Coimbatore District.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

2. The present writ petition is filed praying for a writ of Certiorarified Mandmus challenging the impugned order Ref.no.Na.Ka.22907/2021/AA1 dated 17.08.2023 and to direct the respondents to grant patta to the petitioner in respect of the land comprised in Survey No.210/2 situated at Kunniamuthur village,Coimbatore District.

3. After submitted for a brief while, the learned counsel for petitioner would submit that they may be granted liberty to approach the competent authority for re-classification of subject land as "patta land" from the present classification as "water body".

4. At this juncture, Mr.A.Selvendran, learned Special Government Pleader for respondents would submit that petitioner may submit a representation 2/4

seeking re-classification of subject land before the concerned respondent. If any such representation is made, the same would be considered by the respondents after issuing notice and after affording reasonable opportunity of hearing to the petitioner and other interested parties.

5. In view thereof, the writ petition stands disposed of. It is open to the petitioner to submit a representation seeking re-classification of subject before the concerned respondent. If any such representation is made by the petitioner, the concerned respondent shall consider the same and pass appropriate orders after issuing notice and after affording reasonable opportunity of hearing to the petitioner and other interested parties in accordance with law. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
