COMMON PRAYER:- Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of mandamus to direct the respondents to forthwith allow the petitioners to complete the final year course of B.E.Aeronautical Engineering examination and to publish the results thereto. For Petitioner : M/s.L.Chandrakumar in both the WPs. For respondents: Mr.R.Natarjan for R1.
COMMON ORDER With the consent of both sides, the Writ Petition is taken up for final disposal.
2.The petitioner has come up with the present writ petition for issuance of writ of mandamus to direct the respondents to forthwith allow the petitioners to complete the final year course of B.E.Aeronautical Engineering examination and to publish the results thereto.
3.The petitioners are the 4th year student in the first respondent university studying B.E. Aeronautical Engineer final year. Recently, there was certain misunderstanding between the 3rd year civil engineering department and the 4th year Aeronautical Engineering students, resulting in exchange of wordy quarrel. On 27.07.2015 around 11.30am in the college campus there was exchange of blows between few of the students who had hatred for various reasons inculcated between themselves and on 28.07.2015 a compromise talk took place and a quietus was given to the problem and misunderstanding between the students was settled and returned back to hostel. Subsequently, again a problem was broken out resulting in one N.Sundaralingam, 3rd year Civil Department student approached the inspector of police and lodged a complaint and case was registered for the offences under Section 147, 148, 341, 294 (b), 324, 307 IPC.
4.During the pendency of the criminal complaint the petitioners were not permitted to undergo their academic course, which commenced from 18.01.2016.
Hence, the petitioners approached this Court.
5.When the writ petitions are taken up for consideration, the learned counsel appearing for the first respondent submitted that they are not preventing any students in attending the classes and further stated that the petitioner in WP.No.3864 of 2016 is attending the course B.E. Aeronautical Engineering. The first respondent further submits that they did not restrain the petitioners in WP.No.6057 of 2016 in attending the B.E.Aeronautical Engineering classes and in completing their final year course. 6.Recording the submissions so made by the learned counsel for the first respondent, both the writ petitions are closed. The petitioners in WP.No.6057 of 2016 are permitted to attend the B.E.Aeronautical Engineering final year classes. No costs. Consequently, connected miscellaneous petitions are also closed.
