ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 08.11.2021 for the offences under Sections 406, 420, 506(i) of IPC, in Crime No.02 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused on the false promise of securing job in Government sector, had obtained a sum of Rs.45,00,000/- from the de facto complainant and 15 others and thereafter, they neither arranged any job nor returned the amount. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 35 days from 08.11.2021. Hence, he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the petitioner and other accused on the false promise of securing job in Government sector, had obtained a sum of Rs.45,00,000/- from the de facto complainant and 15 others and thereafter, they neither arranged any job nor returned the amount and that the petitioner is arrayed as A3 who has acted as a Broker. The main accused/A1 has died and that A2 is the wife of A1 and the investigation has not been completed.

5. It is a case of job racketing and a sum of Rs.45 lakhs is involved in this case and 16 victims have been cheated and therefore, the case needs a detailed investigation and if the petitioner is released on bail there is every possibility of the petitioner getting abscond. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
