O R D E R

The Criminal Original Petition has been filed seeking relaxation of the condition imposed by the learned Judicial Magistrate No.II, Mettur, in Crl.M.P.No.245 of 2025 dated 08.07.2025, in connection with Crime No.340 of 2025, directing the petitioner to sign before the All Women 1/4

Police Station, Mettur, once in 15 days at 8 a.m.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent.

3. The petitioner was earlier reported missing from her family and based on the complaint given by her parents, a case in Crime No.340 of 2025 was registered by the respondent Police for 'Woman Missing'. Subsequently, the petitioner surrendered before the jurisdictional court and the learned Judge has rightly directed the respondent to close the First Information Report in Crime No.340 of 2025 under due process of law. However, while doing so, the leaned Judge also imposed a condition directing the petitioner to sign before the All Women Police Station, Mettur, once in 15 days at 8 a.m.

4. It is relevant to note that the petitioner is not an accused and that she is working as a teacher. Due to matrimonial dispute, she is presently residing in a Women's hostel. In such circumstances, this Court is of the view that the condition directing the petitioner to sign before AWPS,Metter 2/4

once in 15 days is unwarranted. The petitioner, aged about 28 years and being a teacher, has every right to reside at a place of her choice.

5. Accordingly, the Criminal Original Petition is allowed and the condition imposed by the learned Judicial Magistrate No.II, Mettur, in Crl.M.P.No.245 of 2025 dated 08.07.2025 is relaxed. 18.08.2025 ham To
