This writ petition has been filed for issuance of Writ of Mandamus directing the 3rd respondent to consider and pass orders on the petitioners' representation dated 03.08.2019 by revising the seniority of the petitioners by placing them above the Serial No.13 in the Integrated Seniority List of the cadres Line Inspector and Commercial Inspectors published by the 3rd respondent on 28.05.2019 and promote the petitioners as Foreman Grade-I.
2. The petitioners were initially appointed as Helper Trainee during the year 1997. Later, the petitioners were promoted as Wiremen by the respondent corporation. According to the petitioners, while fixing seniority among the Wiremen, the respondent corporation has placed juniors of the petitioners, which was questioned by the petitioners. While so, again the petitioners were promoted as Line Inspectors and the petitioners were under the impression that their seniority would be re-fixed in appropriate place in the cadre of Line Inspector. But, to their shock and surprise, while giving promotion to the post of Foreman Grade-I, the respondent corporation fixed the same seniority without considering their request made earlier. In such circumstances, the petitioner made detailed representation dated 03.08.2019, to the respondent corporation. Since no action is forthcoming from the respondent corporation, the petitioners are before this Court.
3. Learned counsel for the respondents would submit that if direction is given by this Court to consider and dispose of the representation of the petitioners, the same would be considered in accordance with law.
4. Considering the facts and circumstances of this case, this Court is inclined to issue direction to the respondents to dispose of the representation, if not disposed of already, within a period of fourteen weeks from the date of receipt of a copy of this order.
5. With the above direction, the Writ Petition is disposed of. No costs.
