O R D E R

The Revision challenges the order passed by the Family Court in Crl.M.P.No.6 of 2024, allowing the petition filed by the respondent herein to set aside the ex-parte order on the condition that he pays Rs.30,000/-.

2.The learned counsel for the petitioner/wife, would submit that the trial Court ought to have dismissed the petition as the respondent has filed the same only to delay the proceedings; that in any case, the condition imposed by the trial Court is not commensurate with the delay caused by the respondent; and prayed for setting aside the order. 3.The learned counsel for the respondent however, would submit that pursuant to the directions of this Court, the respondent had already paid a sum of Rs.1,50,000/- to the petitioner, pending this Revision and produced the copy of the DD to prove the same and submitted that the impugned order may be confirmed.

4.In view of the fact that the respondent has already complied with the order of this Court and has paid a sum of Rs.1,50,000/- to the petitioner, this Court is of the view that the impugned order can be sustained and the respondent may be permitted to contest the case on further condition to pay a sum of Rs.50,000/- (Rupees Fifty Thousand only) within a period of two weeks to the petitioner. 2/4

5.The Trial Court shall dispose of M.C.No.75 of 2022, within a period of four months.
