Respondent Prayer : Transfer Civil Miscellaneous Petition under Section 24 of C.P.C., is filed to order withdrawal and transfer of HMOP No.2873 of 2023 from the file of the Learned V Additional Family Judge, Chennai to the file of the Learned Subordinate Court at Madurantakam.

O R D E R

This petition has been filed by the petitioner seeking to withdraw and transfer the HMOP No.2873 of 2023 from the file of the Learned V Additional Family Judge, Chennai to the file of the Learned Subordinate Court at 1/4

Madurantakam.

2. The learned counsel for the petitioner submitted that the marriage between the petitioner and the respondent was solemnized on 02.02.2006. He further submitted that the petitioner has been tortured at the hands of the respondent and his family members. Thereafter, the respondent filed HMOP No.2873 of 2023 on the file of the Learned V Additional Family Judge, Chennai, making false allegations against this petitioner. He further submitted that the petitioner is residing at Madurantakam Taluk, Chengalpattu with her aged parents and it is very difficult for the petitioner to attend the court hearings at Tambaram. Hence, he prays to transfer the HMOP No.2873 of 2023 from the file of the Learned V Additional Family Judge, Chennai to the Hon'ble Subordinate Court at Madurantakam.

3. The learned counsel for the respondent has not entered appearance in the present case.

4. Considering the facts and circumstances of the case and also the fact that the petitioner, the reasons stated by the petitioner and the same is justifiable. 2/4

Accordingly, the present Tr.C.M.P. is allowed and the HMOP No.2873 of 2023 pending on the file of the Learned V Additional Family Judge, Chennai is withdrawn and transferred to the file of the Hon'ble Subordinate Court at Madurantakam. No costs. Consequently, connected miscellaneous petition is closed.
