Upon perusing the grounds of Appeal, the order of the Lower Court and material papers in this case and upon hearing the arguments of Mr.A.Sundaravadhanan, Counsel for the appellant and Mr.G.Pavendhan, counsel for the respondent, this Court, while dismissing the Second Appeal with cost, doth order and decree as follows:

1.that the judgment and decree dated 06.10.2016 made in A.S.No.51/2014 on the file of the I Additional District Judge, Erode confirming the judgment and decree dated 26.03.2014 made in O.S.No.48/2012 on the file of the Principal Subordinate Judge, Erode, be and hereby is confirmed;

2.that the appellant herein do pay the respondent herein a sum of Rs.10/-(Rupees Ten only)towards cost incurred in the above Second Appeal.
