Prayer:- This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus, calling for the records relating to the proceedings in Rc.No.A1/5505/2022 dated 22.09.2022, on the file of the fourth respondent herein and to quash the same and direct the respondents to grant family pension to the petitioner as the widow of the deceased T.N.A.Ravisankar, worked as a Store Keeper in the Tamil Nadu Government Central Automobile Workshop, Velachery, Chennai 600 042, the fourth respondent herein, who died on 26.03.2022, under the provisions of Tamil Nadu Pension Rules, within a time frame as may be fixed by this Court.

ORDER
The petitioner's husband T.N.A.Ravisankar had retired from service of the respondent Workshop on 31.07.2011. During his service, he had not enrolled his wife's name, who is the petitioner herein, in his Service Register. As per the marriage invitation, the petitioner was married to the late employee on 21.04.2003. After retirement, he had requested the second respondent to enroll the details of his marriage with the petitioner herein in his Service Register. The request was forwarded by the fifth respondent to the respondents 1 and 2 on 21.03.2012 itself seeking for clarification. However, no orders were passed on the same.
2. In this background, the petitioner's husband died on 26.03.2022. The petitioner already seeks to have her name enrolled in the Service Register of the late employee as his legal heir.
3. Today, when the matter was called, the learned Government Advocate submitted that though they had rejected the petitioner's request for enrollment of her name in the Service Register of T.N.A.Ravisankar on the ground that the employee had opted for Single Window Pension 4/7
System, they had sought for clarification as to whether the registration of a nominee can be made in the Service Register of T.N.A.Ravisankar after his retirement.

This Court is of the view that in case the petitioner is in a position to substantiate that she is the wife of late employee, the respondents 1 and 2 can be directed to enroll her name in the Service Register of T.N.A.Ravisankar. In this background, the petitioner is granted liberty to make an appropriate application to the third respondent herein, seeking for enrollment of her name in the Service Register of T.N.A.Ravisankar. On receipt of the same, the third respondent forthwith forward the application to the respondents 1 and 2, who in turn shall pass appropriate orders within a period of four weeks therefrom.
5. The Writ Petition stands ordered accordingly. No costs. 14.06.2023 Index : Yes/No pvs 5/7
